Project foresees reduction of points on the CNH after six months without new traffic violations

Bill 3412/23 proposes a reduction of 1/3 in the points accumulated on the National Driving License (CNH) for drivers. According to the text, the subtraction could occur within a period of six months, if the driver or pilot does not commit new infractions. The proposal is under analysis in the Chamber of Deputies.

If approved, the PL must change the Brazilian Traffic Code. According to Agência Câmara, the proposal will still be analyzed conclusively. Following the process, the project must go through the Road and Transport committees; and Constitution and Justice and Citizenship. To become law, the text must be approved by the Chamber of Deputies and the Federal Senate.

Currently, the 12-month period is the maximum time for adding points between the first and last fine that form a scoring process. According to the São Paulo DMV, if the driver does not reach the legal score limit within a period of 12 months, there is no loss or restriction on his driver’s license.

In September, around 418 thousand notifications of suspension or revocation of the driver’s license were issued by Detran-SP, and some of the drivers who received these notifications discovered that they had lost the right to drive due to infractions committed in 2020 and 2021.

CNH points system

The CNH points system deducts from the driver depending on the severity of the infraction committed, which can vary between very serious and minor. Very serious fines are deducted seven points; the serious ones, five; averages take four points; and the light ones, just three. The maximum point limit is 40 points per driver’s license for drivers who have not committed very serious infractions.

Since 2020, the accumulation of maximum points takes into account the number of very serious infractions that the driver committed. For those who have committed up to two very serious infractions, the maximum point limit becomes 20. Likewise, if there is a very serious infraction, the limit increases to 30 points. Upon reaching the score limit, the driver may have their driver’s license suspended.
